CORRECTION OF CERTAIN OVERSIGHTS
 
DISCUSSION:
The purpose of this memorandum is to correct a past oversight in IMNL at 0205.040.05.  Item 4. in this section, which instructs staff to determine IM eligibility for refugees and Cuban/Haitian entrants under the Refugee Resettlement program, should have been removed when memorandum IM-#108, dated September 25, 1991 was issued.

Correct policy is to explore eligibility for Temporary Assistance, and grant benefits under that program, if eligibility exists, when the applicant is a refugee or Cuban/Haitian entrant.  Only if eligibility for Temporary Assistance does not exist would there be eligibility for the Refugee Resettlement program.  This has been policy since September 1991.  However, due to an oversight, the Temporary Assistance manual contained incorrect policy.

Another oversight, at 0205.045.00, is also corrected.  Items 2. and 3., and the final paragraph in this section are deleted.  The policy requiring assignment of a protective payee for non-cooperation was removed when the Temporary Assistance manual was revised by memorandum IM-#166, dated December 17, 1998.
