CORRECTION TO MEMORANDUM IM-#14
 
DISCUSSION:
Memorandum IM-#14 (1/20/00) contains incorrect information concerning the exclusion of EIC payments from resources for the Food Stamp Program.  Correct policy, as stated in IMNL 1110.020.30, is as follows:
  • Exclude the Earned Income Tax Credit (EIC) in the month received and the following month.
  • Exclude EIC payments for 12 months when received by any household member meeting both of the following:  1)  was a food stamp participant at the time the payment was received and  2)  participates in the Food Stamp Program continuously for the 12 months of the exclusion period. 
IMNL 1110.020.30 also defines continuous participation.
 
NECESSARY ACTION:
  • Review this memorandum with appropriate staff.

  • Apply correct food stamp policy as stated in IMNL 1110.020.30.
