DISCUSSION:
Food stamp policy for determining resources and income budgeting procedures for households containing ineligible immigrants is changed with regulatory changes effective June 1, 2001.  Consider all resources and all but a pro rata share of the income and expenses of ineligible immigrants for the remaining household members.  This is the same resource and income budgeting procedure used for immigrants with temporary status and undocumented immigrants.

Food stamp policy regarding sponsored immigrants is changed.  Do not deem the resources and gross income of a sponsor or a sponsor's spouse for an ineligible immigrant. 

Implement policy for income and resources of ineligible immigrants at initial certification and at the next recertification for active food stamp households.

The Food Stamp Manual is revised to reflect the new policy.

 
NECESSARY ACTION:
  • Review this memorandum with all appropriate staff.
  • Consider all resources and all but a pro rata share of income of ineligible immigrants. 
  • Implement policy at initial certification and at the next recertification for active food stamp households.
  •  File the manual revision in the hard copy of the Intranet Food Stamp Manual.
