IM-179  09/27/01 CLAIM PAYMENTS

CLAIM PAYMENTS
 
DISCUSSION:
Currently, when households with more than one claim make cash, check, or money order payments and do not state to which claim(s) the payment applies, the payment is applied to one claim.  Effective September 24, 2001, these payments are divided among the programs with claim balances.  The payment is applied to:
  • judgments entered by the court, then
  • promissory notes signed by the household, then
  • divided equally among programs with a claim balance.
Example:  Mr. A sent a check to pay on a claim and did not state to which claim the payment applies.  Mr. A has two food stamp claims, one Temporary Assistance claim, and one Medicaid claim.  There are no judgments or promissory notes.  The payment will be divided by three programs and one-third applied to each program.
A county agreement is not considered a promissory note.

If the household wants the payment to be applied to a specific claim balance, the household must state to which claim the payment applies when the payment is made.

 
NECESSARY ACTION:
  • Review this memorandum with appropriate staff. ·
  • Inform households that payments made on claim balances are divided among the claims, unless it is stated to which claim the payment applies.
