IM-205  11/29/01  MEDICAL SUPPORT REFERRALS FOR SPECIAL MC+ CASES
FAMILY HEALTHCARE MANUAL REV # 50
SECTIONS 0905.010.40.05; 0920.010.30.05

SUBJECT:
MEDICAL SUPPORT REFERRALS FOR SPECIAL MC+ CASES
FAMILY HEALTHCARE MANUAL REV.# 50
SECTIONS 0905.010.40.05; 0920.010.30.05

DISCUSSION:
Division of Child Support Enforcement (DCSE) cannot establish a child and/or medical support obligation for an emancipated child.  DCSE also cannot act on behalf of a child in the physical custody of an unrelated caretaker who does not have legal guardianship or custody.

Effective immediately it is no longer necessary to refer the following recipients of MC+/Medicaid only benefits to Division of Child Support Enforcement:

  •  A child under the age of 19 who is not living with a caretaker and who applies for MC+ in his/her own name; and
  •  A non-related caretaker applying for a child in their physical custody for whom they do not have legal guardianship or legal custody.
Section 0920.010.30.05 and 0905.010.40.05 of the Family Healthcare manual have been revised to reflect this change.

NECESSARY ACTION:
  • Share this memorandum with all appropriate staff.
  • File the revised Section 0920.010.30.05 and 0905.010.40.05 in the Family Healthcare manual.
  • Discontinue submitting CSE-201s to Division of Child Support for the above referenced cases immediately.
