PATERNITY STATEMENTS
TEMPORARY ASSISTANCE MANUAL REVISION #12
 
DISCUSSION:
Section 333(3)(D) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA) requires a change in the way we approach paternity statements in Two Parent Households.

In all Temporary Assistance cases establish the father's relationship to his child.  If the father is not married to the mother offer the father the opportunity to voluntarily sign the Affidavit Acknowledging Paternity (VS-465).  If the father refuses to sign the paternity statement, the family is still eligible for Temporary Assistance-Two Parent Household if they meet the other eligibility factors.  We will no longer reject applicants when the paternity statement is not signed.  The father may seek legal counsel prior to signing the paternity statement.

 
NECESSARY ACTION:
  •  Discuss this memorandum with all appropriate staff.
  • Begin following the new procedures for voluntary signing of paternity statements immediately.
  • File the revised manual revision (.pdf, 9 kb, 2 pgs.) in the Temporary Assistance Manual.
