MEMORANDUM

DISCUSSION:

On May 4, 2009, the Circuit Court of Cole County issued an Order in the Gerken v. Sherman class action lawsuit against the Department of Social Services that no data relevant to the lawsuit shall be purged or otherwise destroyed. The lawsuit affects Supplemental Aid to the Blind (SAB), Blind Pension (BP), and Aid to Blind (AB) conversion cases. Until further notice, do not purge, destroy, or expunge any information relating to SAB, BP, or AB cases. The Order pertains to all records and information, including records and information maintained electronically or in e-mail form.

NECESSARY ACTION:

• Review this memorandum with all appropriate staff.
• Do not purge, destroy, or expunge any information relating to SAB, BP, or AB cases until further notice.
