DISCUSSION:
Training curriculum to assist Income Maintenance staff with due process and administrative hearings is being developed and will be available in the Employee Learning Center (ELC).
The first course in the Administrative Hearings Training curriculum is available and is titled “Introduction to Administrative Hearings and Due Process” and is course code FS000144. This course takes approximately one hour to complete. Prior to beginning the course make sure you allow adequate time to complete the course prior to the end of the day. If you need to take a break, minimize the screen but do not exit the course. If you exit the course and restart it, the system will take you back to the beginning of the course.
This training provides important information regarding the right of Income Maintenance participants to due process and to receive an impartial administrative hearing, including:
- defining due process;
- explaining the importance of an administrative hearing;
- listing the requirements of a timely and adequate notice relating to adverse actions; and
- discussing the legal principles involved in administrative hearings and due process.
There is a scored assessment for this training, on which the trainee must receive a 70% or higher to pass. This training course must be completed and passed by all eligibility specialists, eligibility supervisors, and program and county managers by March 1, 2011. The ELC will track compliance with this requirement and notify supervisors and managers of any individuals who need to complete this training. New staff should take this training within 60 days of being hired into the eligibility specialist position.
The training can be taken again if ES or supervisory/management staff feel there is a need for a reminder. Other Income Maintenance staff may also complete this training as needed. Follow normal procedures for enrolling and completing online training, or enrolling staff for the training.
