DISCUSSION:
This memorandum is to clarify how to consider disability for the Food Stamp Program when an individual is receiving disability benefits from a government agency having a disability as defined by SSA (RGA).
There are two factors to review and the retirement benefit must meet both requirements:
- The disability benefit is from a government agency, and
- The disability criteria for the disability for the government agency is the same as defined by SSA.
EXAMPLE: Public School Retirement System (PSRS) disability benefits are considered from a government agency, but the disability criteria for PSRS does not meet
the disability criteria as defined by SSA. Therefore this member is not disabled for the Food Stamp Program.
NECESSARY ACTION:
- Review this memorandum with all appropriate staff.
