DISCUSSION:

The purpose of this memorandum is to introduce a manual revision concerning claims hearing request timeliness. Only enter a "Y" and the date (mm/dd/yyyy) the hearing was requested in the FAIR HEARING REQ field on the CARS Change Claim Information (OVCC) screen if the request was made within 90 days from the date established shown on OVCC.

Collections are not to be stopped on the claim due to a fair hearing request when the request is received more than 90 days from the date established. Entering Y in this field will incorrectly prevent recoupment when the request is received more than 90 days from the date established.
