FAMIS RELATIONSHIP CODE UPDATE REGARDING SAME SEX MARRIAGES

DISCUSSION:

On June 26, 2015 the Federal Supreme Court ruled that all states must issue marriage licenses to same-sex couples and to recognize same sex marriages validly performed in other states.

The purpose of this memorandum is to notify staff of a change in the Family Assistance Management Information System (FAMIS).   Effective August 14, 2015, FAMIS will allow entry of two individuals of the same sex for:

FOOD STAMP ELIGIBILITY UNIT GROUPS

There is no change in Food Stamp policy 1105.015.04.15 Mandatory Eligibility Unit Groups.  

Due to the Supreme Court ruling and FAMIS changes, same sex spouses and parents are mandatory Food Stamp EU members and must be included in the EU regardless of whether they purchase and prepare food together. 

TEMPORARY ASSISTANCE ELIGIBILITY UNIT

There is no change in Temporary Assistance policy 0210.005.00 Individuals Whose Income and Needs to Consider

Due to the Supreme Court ruling and FAMIS changes, same sex spouses and parents are now recognized as a legal relationship and are subject to the mandatory inclusions and exclusions outlined in the Temporary Assistance Manual.

MO HEALTHNET FOR AGED, BLIND, AND DISABLED EILIGIBILITY UNIT

There is no change in Income Maintenance policy 0805.015.05 Persons Whose Income and Needs Are Considered

Due to the Supreme Court ruling and FAMIS changes, same sex spouses and parents are now recognized as a legal relationship and are subject to the inclusions and exclusions outlined in the Income Maintenance manual. 

CHILD CARE FAMILY UNIT

There is no change in Child Care policy 1210.005.00 FAMILY UNIT

Due to the Supreme Court ruling and FAMIS changes, same sex spouses and parents are now recognized as a legal relationship and are subject to the mandatory inclusions outlined in the Child Care manual.
