DISCUSSION:
The ADAWD time limit does not apply to an individual receiving temporary or permanent disability benefits issued by government or private sources because they meet the exemption for unfit for employment.
Staff must accept receipt of Veterans Disability (VA) disability compensation – regardless of disability rating – for the purpose of determining and verifying this exemption from the ABAWD time limit.
Furthermore, staff must grant a permanent exemption to individuals who receive permanent disability benefits regardless of percentage of disability.
NECESSARY ACTION:
- Review this memorandum with appropriate staff.
