EXCLUSION OF PASS (PLAN FOR ACHIEVING SELF-SUPPORT) AS INCOME AND RESOURCES
DISCUSSION:
Due to Federal guidelines and directives, effective immediately exclude income and resources from an SSI Plan for Achieving Self-Support (PASS, as defined below) for GR, SAB, SNC, MA, and SP.  Also exclude income from a PASS in determining eligibility for Medicaid for Children.

This policy became effective for Food Stamps in MEMO #74 dated September 2, 1992.

We have effective SSI exclusions in the AFDC cash assistance program that meet these criteria.

PLAN FOR ACHIEVING SELF-SUPPORT (PASS) ACCOUNT

Blind or disabled SSI recipients may have a plan in writing and approved by the Social Security Administration to set aside money for a certain amount of time for a work goal.  This plan is for achieving self-support (PASS).  Income and resources that are set aside under an approved PASS are excluded from countable income and resources for as long as the plan is in effect for blind or disabled SSI recipients.  The claimant receives an approval letter from SSA when a plan is approved.

A plan can be approved initially for up to 18 months, may be extended, but can never exceed 48 months.  The plan can be amended with approval from SSA.  SSA must periodically review plans to assure compliance.

The last effective month for a PASS is the earliest month in which one of the following events occur:

  1. The individual is no longer in substantial compliance with his/her plan;

  2.  
  3. The individual voluntarily abandons his/her plan;

  4.  
  5. The specified time limit expires and no extension is reached.

  6.  
  7. The occupational objective outlined in the plan is reached.
The PASS account becomes a resource at the time any of the above occur.
NECESSARY ACTION:
  • Review this memorandum with all appropriate staff.
  • Effective immediately, exclude eligible PASS income and resources when determining eligibility.
