IM-31  04/01/99  ADMINISTRATIVE HEARING UNIT REORGANIZATION

ADMINISTRATIVE HEARING UNIT REORGANIZATION
 
DISCUSSION:
The Division of Legal Services has reorganized the counties served by the Administrative Hearing Units (AHU).  Attached is a listing of counties served by each AHU.  Continue faxing IM-87, Application for State Hearing, on all food stamp hearing requests.  Check the attached listing to determine if your county is being served by a different AHU.  If so, immediately begin faxing food stamp hearing requests to the appropriate AHU.

Staff is to implement food stamp hearing decisions within 60 days of the date of the hearing request.  When Program and Policy completes the review of hearing reversals, a Lambus vs. Walsh Email document is sent to the county office advising of the hearing decision.  This document is being sent to give county offices additional time to implement the decision.  Upon receipt of the Lambus vs. Walsh Email document, take action to implement the hearing decision.  Do NOT wait to receive the signed copy of the hearing decision before proceeding to implement the decision.  If you do not receive a signed copy of the hearing decision within five days after receipt of the Lambus vs. Walsh Email document, follow-up by calling your AHU.  

We must continually strive to meet the expectations of the court.  We are not only court ordered to implement food stamp hearing decisions within 60 days, but it is also a federal requirement.  

Through the improved efforts of all staff involved in the hearing process, we can meet these expectations.

 
NECESSARY ACTION:
  • Discuss this memorandum with all appropriate staff.

  • If your county was assigned to a new AHU, begin faxing food stamp hearing requests to the new AHU.
