As soon as possible but within 2 calendar days of the date of the scheduled hearing, the exhibits documenting the FSD action are available to:
- The AHU; and
- The EU and their representative, if any.
NOTE: Federal regulations at 7 CFR 273.15(p)(1) allow the FSD to withhold from the EU, confidential Food Stamp case information, like the name of someone reporting fraud or the status of a criminal case. Confidential information will not be provided and will be removed from the case file before allowing the client or client’s representative to review the case file. Any confidential information removed from the case file may not be presented at the hearing and may not be made available to the hearing officer who will decide the issue.
