0505.025.10 Operating a Motor Vehicle

Section 209.030 RSMo A person who operates a motor vehicle with or without a driver license or permit is not eligible for Blind Pension.

A motor vehicle is defined in Section 301.010, RSMo, as “any mechanical device on wheels, designed primarily for use, or used, on highways, except motorized bicycles, vehicles propelled or drawn by horses or human power, or vehicles used exclusively on fixed rails or tracks, or cotton trailers or motorized wheelchairs operated by handicapped persons.”

Operating a motor vehicle while receiving Blind Pension will result in progressively longer disqualifications.

  1. First offense will result in 2 year disqualification from the date the participant is determined to have operated a motor vehicle.
  2. Second offense will result in 4 year disqualification from the date the participant is determined to have operated a motor vehicle.
  3. Third offense will result in permanent disqualification from the date the participant is determined to have operated a motor vehicle.

Operating a motor vehicle can be verified by:

  • Receipt of a moving violation while driving,
  • WIU investigation supporting an accusation of operating a motor vehicle, or
  • Participant statement that s/he has driven while receiving Blind Pension.
