IM-94 June 11, 2019; IM-68 June 15, 2017
In order to be eligible, the claimant must not own real or personal property in excess of set resource limits for an individual or couple, if married and living together or separated for the purpose of receiving medical care or nursing home care for dates prior to July 1, 2018. As of July 1, 2018, the resource maximums for AB are the same as those for OAA/PTD found in 1030.000.00 Available Resources (OAA and PTD). Property considered would be that owned by either spouse or both.
NOTE: The resource maximum changes effective for MO HealthNet under AB criteria do not apply to Blind Pension (BP) cases.
If the spouses are separated for any reason other than for the purpose of receiving medical care or nursing home care, each may own real or personal property less than the single person resource limit. In such cases, if property is owned jointly, consider one-half of the combined equity in the property in determining the eligibility of each participant. This includes the equal distribution of all jointly owned real and personal property in which both spouses are recorded owners.
Refer to MHABD Appendix J for the current resource limits.
