2010.005.00 ELIGIBILITY UNIT (EU)

The following are mandatory members of the ‘Eligibility Unit’, when living in the same household. The income and needs of all mandatory members will be considered when determining eligibility for Child Care Subsidy.

  1. The child(ren) for whom care is requested;
  2. The child’s biological or adoptive parent, or resource (foster, relative, or kinship) provider(s) (whether married or unmarried);
  3. The biological or adoptive parent, or resource (foster, relative, or kinship) provider’s spouse;
  4. The child(ren)’s biological, step-, half-, or adopted sibling(s) under 18 years of age;
  5. The unmarried parental partner who is the parent of the child’s sibling(s);
  6. The child(ren) under 18 years of age of the unmarried parental partner if the two parents share a child in common;
  7. The non-parent caretaker relative (NPCR) and spouse if no biological or adoptive parent or legal guardian resides in the household;
    • NPCR is a specified relative, other than a parent, who is the caretaker of the eligible children, per 0210.005.35 Non-Parent Caretaker Relative (NPCR) of the Temporary Assistance Manual.
  8. The legal guardian applying as “head of household” or “caretaker” of the child needing care;
    • A caretaker is a specified relative exercising primary responsibility for care and control of the eligible child, per 0210.005.35 Non-Parent Caretaker Relative (NPCR) of the Temporary Assistance Manual.

Some options to consider when determining Child Care Subsidy eligibility are:

  1. If a child is a mandatory group member, s/he must be added to the eligibility unit (EU), whether or not the child is in need of care.
  2. A school-age child who is the parent of a child in the same home may choose to be considered a separate ‘Eligibility Unit’.
  3. The payee may include other children (grandchildren, nieces, nephews, etc.) living in the home for whom the payee is responsible in the eligibility unit as part of the Child Care Subsidy household, even if these optional member(s) do not need child care services.
  • If the child is an optional group member, add the child to the EU to determine the effect on the case.
    • If adding the child results in a decreased sliding fee, include the child in the EU.
    • If adding the child results in the case closing, exclude the child from the EU.
    • If adding the child results in an increased sliding fee, inform the head of household of the option of including or excluding the child and the results of each action and let the head of household decide whether to include or exclude the child. Document the head of household’s decision.
  • If a child included in the eligibility unit as an optional member becomes ineligible, remove the child from the eligibility unit.  If the family does not appeal the notice of adverse action, the system will remove the child from the eligibility unit and close the child’s authorization to the provider, if applicable.
    • The eligibility system generates a notice to the EU of any action taken on the child care case.
