The legal basis for program administration and eligibility determination for individuals is set forth in Title IV-A of the Social Security Act, Section 208.010 Revised Statutes of Missouri, and Title 13 Code of State Regulations Division 40 Chapter 2, as follows.
In determining eligibility under this law, FSD considers all facts and circumstances surrounding the family, including living conditions, earning capacity, and income and resources. A decision is then made regarding the family’s eligibility for cash benefits.
Section 208.024 Revised Statutes of Missouri (RSMo) prohibits use of Temporary Assistance benefits issued on an EBT card at specified establishments or in any place or for any item that is primarily marketed for or used by adults eighteen or older and/or is not in the best interests of the child(ren) or household.

The laws, rules, and regulations as set forth in this manual apply to parent(s) in the home and eligible children.
