This memorandum is to clarify policy when
a food stamp claim is to be established, which was discussed in Memorandum
IM-#144 and Memorandum IM-#146.
ALWAYS ESTABLISH A CLAIM:
-
if the overpayment is over $125, or
-
for any amount of overpayment if the household
is participating in the Food Stamp Program, or
-
for any amount of overpayment if it was discovered
in a quality control review.
DO NOT ESTABLISH A CLAIM:

if a claim has already been established for
the overpayment, or
-
if the overpayment is $125 or less, is not
discovered in a quality control review, AND the household is NOT participating
in the Food Stamp Program.
Example: Mrs. Ashley received an overpayment
of $30 in the month of August 2001. The overpayment was discovered
by the caseworker at recertification and the case is active. The
claim is under $125, however the household is participating, so a claim
is established.
A claim referral may be rejected using
reason code 05 (Overpayment less than threshold), if it meets the above
rules for not establishing a claim. |
