SECTION 1105.099.00  APPENDIX C - GUIDE FOR DETERMINING ELIGIBILITY OF QUALIFIED IMMIGRANTS FOR FOOD STAMPS
 
DISCUSSION:
Effective October 1, 2002, disabled immigrants no longer are required to have been in the United States on or before August 22, 1996.  Any qualified immigrant who is otherwise eligible and who receives blind or disability benefits may receive food stamp benefits regardless of the date of his/her entry into the United States. 

To be considered disabled, the household member must meet the food stamp definition of disabled.  To determine if an individual is disabled, refer to the online Food Stamp Manual, section 1100.010.00 Definitions, elderly or disabled member.

Apply this policy at the next certification or next contact with households.

For FAMIS users, enter the appropriate status for the individual (Amerasian, refugee, etc.) in the Status field of the Non-Citizen Information screen (FMML).  Record the disability on the Disabled screen (FMMX).  Only use CED status code for disabled individuals who are lawful permanent residents and do not meet another status code. 

For Legacy users, no programming changes were required.  If a disabled immigrant was previously ineligible for food stamps because s/he was not in the United States on or before August 22, 1996, remove the A code in field 26 of FSU5.  Continue to use the appropriate Citizenship code in field 43 of FSU5.

  • Discuss this memorandum with all appropriate staff.
  • Implement this policy at the next contact or next certification of households.
