SUSPENDED EXECUTION OF SENTENCE POLICY FOR THE FOOD STAMP PROGRAM
DISCUSSION:
The purpose of this memorandum is to clarify Food Stamp Policy for individuals who receive a suspended execution of sentence (SES).  An SES is considered a conviction and the defendant is actually sentenced to a specific period of incarceration, but may not have to serve the sentence if conditions of probation are met.

A suspended imposition of sentence is not considered a conviction because the defendant is not given a sentence unless s/he does not meet the conditions of probation.

Disqualify individuals who receive an SES for a felony drug offense committed after 8/22/1996.  Do not disqualify individuals who receive an SIS for a felony drug offense.

The Food Stamp Manual is revised online to reflect this clarification.  A hard copy is not being sent at this time.
