DISCUSSION:
The purpose of this memorandum is to clarify when a food stamp sanction is cured or ended due to meeting the work registration exemption for subject to Temporary Assistance work requirements or receiving unemployment compensation.
Individual Fails to Comply with Temporary Assistance or Unemployment Compensation Work Requirements
To meet the METP exemption based on Temporary Assistance work requirements or receipt of unemployment compensation, the individual cannot be sanctioned by Temporary Assistance for non-compliance with their work requirements or penalized for not complying with unemployment compensation job search requirements.
Individuals who are sanctioned by Temporary Assistance or unemployment compensation may meet another work registration exemption or exclusion to cure or end a food stamp sanction. For example, a food stamp EU member is sanctioned by Temporary Assistance for non-compliance with their work requirements. However, that same person is responsible for the care of a child under the age of six. Since caring for a child under the age of six is a work registration exemption for food stamps, a food stamp sanction is not imposed.
Follow instructions outlined in Memorandum IM-#42, dated May 4, 2005, to determine whether or not the reduced Temporary Assistance grant or unemployment compensation is budgeted.
Active Food Stamp EU with Sanctioned Individual Applies for Temporary Assistance
When an active food stamp EU makes application for Temporary Assistance, the individuals included in the Temporary Assistance EU with an IN role are exempt from food stamp work registration. If one of the Temporary Assistance EU members is serving a food stamp METP sanction, the sanction is ended when the individual applies for Temporary Assistance because s/he meets the work registration exemption for being subject to Temporary Assistance work requirements.
If the Temporary Assistance application is subsequently denied, re-evaluate the work registration requirements for all EU members age 16 to 60 and assign the most appropriate work registration code. The disqualification period does not resume if the individual no longer meets an exemption or exclusion from work registration.
If an EU member later fails to comply with Temporary Assistance work requirements, determine whether or not another food stamp sanction should be imposed.
The Food Stamp Manual is revised to clarify this policy. The Food Stamp Manual is also revised to remove references to Temporary Assistance case management.
