TEMPORARY ASSISTANCE (TA) SANCTION FOR NON-COMPLIANCE WITH DIVISION OF WORKFORCE DEVELOPMENT (DWD)
TEMPORARY ASSISTANCE/CASE MANAGEMENT MANUAL REVISION #8: SECTION 0295.025.00

DISCUSSION:

Effective with the implementation of Temporary Assistance (TA) into FAMIS, when a TA participant fails to comply with the Division of Workforce Development, FAMIS sanctions the individual on the TA case. FAMIS also lifts the TA sanction when the individual complies with work activities. This memorandum discusses:

Effective Date of Temporary Assistance Sanction

Effective with the date of this memo, a TA sanction is effective for non-compliance of work activities once the adverse action period has expired and the grant has been reduced. This change is reflected in the Temporary Assistance/Case Management Manual Section 0295.025.00

Temporary Assistance Non-compliance

FAMIS takes action to sanction the TA case when FSD receives a DWD notice through the nightly batch regarding 'Noncompliance of Work Activities'. A reminder does not appear on the Alert/Reminder List (FM7M) screen for the TA case. The reminder code, “code received from DWD, determine if FS sanction required” displays when the individual is also receiving food stamp benefits.

FAMIS takes the actions listed below for the TA case (unless the EU is already sanctioned due to non-compliance with child support or already sanctioned for non-compliance of work activity). FAMIS:

No action is necessary by the worker unless the individual requests a hearing. If a hearing is requested within the ten day adverse action period, the worker must take action on the Action Resolution (FM50) screen. Update the status to hold (HOL) and enter the hearing request date. Refer to the Changing an Adverse Action Status user guide.

When a 'Noncompliance of Work Activities' reminder is received from DWD and the individual is already sanctioned due to failure to comply with Child Support, FAMIS takes the following actions:

NOTE: FAMIS does NOT adjust the TA grant if the individual is already sanctioned.

DWD Recommends Sanction Be Lifted

FAMIS takes action to lift the TA non-cooperation with work requirement sanction when FSD receives a DWD notice through the nightly batch regarding 'DWD Recommends Sanction Be Lifted'. A reminder does not display on the Alert/Reminder List (FM7M) screen for the TA case.

FAMIS takes the actions listed below for the TA case (unless the EU is also sanctioned due to non-compliance with child support). FAMIS:

When FAMIS receives notice from DWD in the nightly batch to lift the sanction, and the individual is also sanctioned due to failure to comply with Child Support, FAMIS takes the following actions:

NOTE: FAMIS does NOT adjust the TA grant as the grant remains sanctioned by 25%.

No action is necessary by the worker.

Fails to Comply With Work Activity While Being Case Managed By FSD

When an individual is being case managed by FSD and fails to comply with the work activities, the worker enters the NWR sanction. Complete the following steps:

FAMIS generates an Adverse Action Notice (FA-510) to the individual.

TA Cases in Legacy

Continue to follow current sanctioning procedures for cases processed in the Legacy system.
