DISCUSSION:
The purpose of this memorandum is to provide further information for eligibility specialists (ES) on actions that must be taken to implement Income Maintenance memorandum IM-47 Notification to the Administrative Hearings Unit When Agency Action is Rescinded dated June 1, 2012.
The Administrative Hearings Unit (AHU) reports an increase in the number of participants appealing decisions to the Circuit Court, on cases where the AHU has issued a decision based on the Family Support Division rescinding the case action. The ES must inform the participant that the FSD did not take an adverse action, so the participant is aware that they do not need to appeal the hearing decision.
When an adverse action or closing is rescinded (withdrawn, cancelled, or voided) on cases with a pending hearing on the adverse action or closing, the ES must:
- send the Agency Action Rescinded (IM-90A) form to the appropriate regional AHU,
- send notification to the participant that the action has been withdrawn, cancelled or voided, and that there is no adverse action on the participant's case, and
- enter a comment from the Eligibility Unit Member Role (EUMEMROL/FM3Z) screen to explain why the action was withdrawn, cancelled, or voided, that the IM-90A was submitted to the AHU, and the participant notified. It is important to include a comment so the information is available if the participant calls the Family Support Division Information Center.
