DISCUSSION:
The purpose of this memorandum is to introduce new policy regarding Food Stamp eligibility units (EU) with joint custody children in the household. This policy is effective July 1, 2013, and rescinds prior joint custody policy. Apply the policy at next certification, recertification, or add-a-person application with the eligibility unit (EU).
When children are involved in joint custody situations and receive an equal number of meals from each parent's house, the parents must decide which household will apply for benefits for the child. In instances when the parents cannot reach an agreement, the child will be included in the household that applies first for the entire certification period.
EXAMPLE: Anna and William have 50/50 shared custody of Ava. Neither is designated as primary caretaker. They do not agree on who exercises more control over Ava. They both have Ava for 3 and one half days per week. William applies for Food Stamps first. Ava will be included in William's EU.
