DISCUSSION:
The purpose of this memorandum is to introduce an update to the IM Manual to clarify the age limit for applying transfer of asset penalties to Midwest Special Needs Trusts (MSNTs).
The manual currently states that a MSNT established by a parent, grandparent, guardian, representative payee or court for the benefit of an individual who is disabled, under age 65, and using the individual's own funds, is not considered an available resource for MO HealthNet programs. This memo clarifies the policy for individuals age 65 and over.
Funds transferred to a MSNT for an individual age 65 and over and receiving institutional care are subject to a transfer penalty. The 60 month look-back provision applies in this instance for individuals who are applying for but are not yet receiving institutional care.
