Lawful permanent residents, individuals paroled in the United States under section 212(d)(5) of the INA for at least one year, individuals granted conditional entry under section 203(a)(7) of the INA as in effect before 4/1/1980, and battered immigrants are qualified immigrants (see 1105.010.05 Qualified Immigrants) In order to be eligible for food stamp benefits, these immigrants must meet one of the previous eligible criteria (in the U.S. for five years in a qualified status, disabled, etc.).

- LPR (lawful permanent resident)
- BIM (battered immigrant) status
- CON (granted conditional entry), or
- PAR (paroled)
Acceptable forms of documentation of lawful permanent resident status are:
- USCIS Form I-551; or
- A temporary I-551 stamp in a foreign passport or on Form I-94 for recent arrivals
Acceptable forms of documentation of battered immigrant status are:
- I-130 visa petition; or
- Approved self-petition under the Violence Against Women Act
Acceptable forms of documentation of immigrants granted parole for at least one year:
- USCIS Form I-94 annotated with stamp showing grant of parole under 212(d)(5) of the INA and a date showing granting of parole for at least one year
Acceptable forms of documentation of immigrants granted conditional entry:
- USCIS Form I-94 with stamp showing admission under 203(a)(7) of the INA, refugee-conditional entry
- USCIS Form I-688B annotated “274a.12(a)(3)”, or
- USCIS Form I-766 annotated “A3”
