ENDING FOOD STAMP VOLUNTARY JOB QUIT AND WORK EFFORT REDUCTION SANCTIONS

DISCUSSION:

The purpose of this memorandum is to clarify how an EU member who is sanctioned due to voluntary job quit or work effort reduction may end the sanction.

A number of individuals have been referred to the Division of Workforce Development (DWD) who are currently sanctioned due to voluntary job quit or work effort reduction. Referring these individuals to DWD does not end a voluntary job quit or work effort reduction sanction.

First, determine whether or not the individual meets a work registration exemption or exclusion. If s/he does meet an exemption or exclusion, update the work assessment code on the Employment Assessment (FMMS) screen to the appropriate code. Go to the Sanction/Disqualification (FMAM) screen and end the sanction. If the sanctioned individual does not meet a work registration exemption or exclusion, follow the instructions outlined below for ending a voluntary job quit or work effort reduction sanction.

Ending a Voluntary Job Quit Sanction

To end a voluntary job quit sanction, the individual must work at least 30 hours per week or have earnings equal to minimum wage times 30 hours per week. The sanction can be ended when it is verified when the individual will start a new job, the number of hours to be worked, and the rate of pay. Refer to Section 1105.025.50.30 of the Food Stamp Manual.

Ending a Work Effort Reduction Sanction

To end a work effort reduction sanction, the individual must increase the number of hours worked to 30 or more hours per week. Refer to Section 1105.025.50.35 of the Food Stamp Manual.

Sections 1105.025.50.30 and 1105.025.50.35 of the Food Stamp Manual are revised to clarify that a referral to DWD will not end a voluntary job quit or work effort reduction sanction.
