DRUG ADDICTION AND ALCOHOLIC TREATMENT AND REHABILITATION PROGRAMS

DISCUSSION:
The purpose of this memorandum is to:
- clarify existing policy regarding drug addiction and alcoholic treatment organizations or institutions in which residents may be eligible to receive food stamp benefits; and
- provide procedures for referring organizations or institutions who are not currently licensed by the Department of Mental Health or authorized by the Food and Nutrition Service (FNS) to accept food stamp benefits.
Drug addicts or alcoholics participating in a treatment and rehabilitation program may receive food stamp benefits if the facility providing treatment is approved by FNS as a retailer or is tax exempt and certified by the Department of Mental Health as:
- receiving funds in Missouri under part B of Title XIX of the Public Health Service Act; or
- eligible to receive funding under part B of Title XIX even if no funds are being received; or
- operating to further the purposes of part B of Title XIX to provide treatment and rehabilitation of drug addicts and/or alcoholics.
NOTE: State licensure is not required. The Department of Mental Health must determine that the drug addiction and alcoholic treatment and rehabilitation center meets the above criteria.
To determine if a drug addiction or alcoholic treatment center meets the eligibility criteria to receive food stamp benefits for individuals and their children residing with them during the course of treatment, refer to the Alcohol and Drug Abuse Service Provider Directory . If a drug addiction and alcoholic treatment and rehabilitation center cannot be found in the provider directory, advise the center to contact the Department of Mental Health, Division of Alcohol and Drug Abuse, Provider Certification, who can make a determination as to whether or not the facility is operating to further the purpose of part B of Title XIX to provide treatment and rehabilitation of drug addicts and/or alcoholics. The facility may also be referred to the FNS office serving the county in which the facility is located regarding becoming authorized as a retailer.
Food Stamp Manual sections 1100.010.00 and 1135.005.15 are revised to include this information.
