DISCUSSION:
Effective April 1, 2007, the counties that are waived from meeting the 18-to-50 year-old work requirements are changed. The change affects April 2007 food stamp benefits.
Missouri received approval to waive 39 counties and St. Louis City from meeting the 18-to-50-year-old work requirement through March 31, 2008. The work requirement is for 18-to-50-year-old able bodied adults without dependents (ABAWDS) to work or participate in an approved training program an average of 20 hours per week. Clark County is no longer waived from meeting the 18-to-50 year-old work requirement effective April 1, 2007. Clinton, Montgomery, and Schuyler Counties are waived effective April 1, 2007.
NOTE: METP activities are not qualified training activities for work requirement.

FAMIS considers individuals in these counties as waived from the 18-to-50-year-old work requirement. The eligibility specialist does not have to enter a waiver code and the Training/Work Requirements (FMMR) screen does not appear in the controlled flow.

The following counties are subject to the 18-to-50-year-old work requirement. Eligibility specialists will have to enter the appropriate work requirement code and non-work months on the Training/Work Requirements (FMMR) screen.

FMMR Entries
The Training/Work Requirements (FMMR) screen is used to track non-work months in FAMIS. Review non-work months for individuals who move from a non-waived county to a waived county. Individuals in a waived county do not have to meet work requirement.
When making entries on the FMMR screen, do not enter non-work months for any month in which an individual subject to the 18-to-50-year-old work requirement resides in a waived county or city. Refer to the Adding and Updating Training/Work Requirement user guide for instructions. To view the user guide:
- Go to the Family Support Division Employee Intranet,
- click Food Stamps in the left corner,
- under Quick Links on the right side, click FAMIS User Guides,
- click User Guides, and
- in the Interim Change section, click Adding and Updating Training/Work Requirement.
EU Moves from a Waived to a Non-waived County
Review the Training/Work Requirements (FMMR) screen when an EU moves from a waived to a non-waived county. Enter non-work months or change the work code as applicable. FAMIS gives an ISD (insufficient data) on the Supercase Eligibility Unit Summary (FM30) screen when an action is taken on a case that is in a non-waived county. The ISD appears when a review of the Training/Work Requirements (FMMR) screen is needed. An entry of non-work months and/or a work requirement code may be required.
NOTE: If the work requirement code was previously entered as 50, “No Longer Identified as an ABAWD”, FAMIS will not consider the EU as having to meet work requirement. FAMIS will not produce an ISD. Eligibility specialists must review cases to determine if the correct work requirement code has been entered.
To view the ISD (insufficient data) from the Supercase Eligibility Unit Summary (FM30) screen, go to the Technical Eligibility Detail (FMM4) screen. Press F8=FORWARD to select Work Requirement Eligibility and press F6=DETAILS. Prompt out to get the DCN of the desired EU member. Review the work requirement code and non-work months
Review all pending applications to ensure the correct work requirement code and non-work months are entered.
Review the non-work months during every action, application, and recertification for benefits. Eligibility specialists must inform all EUs of the 18-to-50-year-old work requirement. See the user guide Adding and Updating Training/Work Requirement for instructions on entering, updating, and deleting work requirement codes and non-work months.
EU Moves from a Non-waived to a Waived County
Individuals moving from a non-waived to a waived county do not have to meet work requirement. Review the work requirement code and non-work months on the Training/Work Requirements (FMMR) screen. Change the work requirement code and remove non-work months as applicable.
If an individual moves to a waived county and has been rejected due to having used 3 non-work months in 36 months, review the Training/Work Requirements (FMMR) screen. Remove any non-work months the EU resided in a waived county. Re-register the application if needed, using the original application date. If the original application date is more than 30 days prior to the current date, use the earliest possible registration date. The EU is eligible for food stamp benefits no earlier than the month they began residing in the waived county.
Review non-work months during every action, application, and recertification for benefits. Eligibility specialists must inform all EUs of the 18-to-50-year-old work requirement.
18-to-50-year-old Work Requirement Chart
The chart History of Counties Waived or Exempt from the Work Requirement has been revised. To view the chart:
- Go to the Family Support Division Employee Intranet,
- click Food Stamps in the left corner,
- click Information, and
- click Counties Waived or Exempt .
Manual Revisions
Food Stamp Manual sections 1140.005.15 and 1140.005.20.45 are revised. The revision changes 6 non-work months to 3 non-work months. This change was introduced in Memorandum IM-#106 dated December 7, 2006.
NECESSARY ACTION:
- Review this memorandum with appropriate staff.
- Beginning April 1, 2007, apply waived and non-waived status to the above counties.
