DISCUSSION:
Food Stamp Manual section 1142.055.05 COMPROMISING CLAIMS has been revised. A sentence has been added to notify the EU on form, IM-112, Action Taken on Your Food Stamp Case, of the decision regarding the request for compromise.
If the EU contacts FSD and indicates they will have difficulty paying the claim, the county can consider compromising the claim based on need as defined in Food Stamp Manual 1142.055.05 COMPROMISING CLAIMS. When a decision is made on a request for compromise of a claim balance, the individual must be notified of the decision and be given notification of their right to request a fair hearing if they do not agree. County staff notifies the EU with the form IM-112, Action Taken on Your Food Stamp Case, when compromising a claim based on demonstration of need.
Form IM-112, Action Taken on Your Food Stamp Case, can be accessed through the intranet by clicking on the Forms Manual, Volume II.
NECESSARY ACTION:
- Review this memorandum with appropriate staff.
- Send the IM-112 as notification of compromise decision and hearing rights.
