Once the county office initiates the administrative disqualification hearing, the Hearing Unit schedules the hearing. The hearing officer mails the hearing packet to the EU suspected of fraud at least 30 days in advance of the date an administrative disqualification hearing is scheduled. The hearing packet contains the following:
- notice of State Telephone Hearing;
- the IM-160 Advance Notice of Your Administrative Disqualification Hearing and the pamphlet, Disqualification Hearings Procedures, describing the procedures for an administrative hearing; and
- the IM-161 Waiver of Administrative Disqualification Hearing and IM-161A Withdrawal of Waiver of ADH are included only if they were not offered to the individual previously. The option for the individual to voluntarily sign the IM-161 is only offered once. If the individual was offered the forms and chose not to waive his/her hearing rights, the forms are not included in this hearing packet. The individual’s decision to not sign the IM-161 is documented on the FSD/WIU Tracking form.
