If the disqualification decision results from a criminal or civil court procedure, the judgment made by the court is used in applying the disqualification penalty.
- If the court finds against FSD, WIU notifies the caseworker of the decision. If the individual is active, review the benefit level for correctness and continue issuance. If the individual is inactive but reapplies, process the application.
- If the court finds the EU member guilty, WIU enters the disqualification into FAMIS, which imposes the disqualification.
- The length of the disqualification is the number of months ordered by the court. Enter the number of months in the Length field on the Sanction/ Disqualification (FMAM) screen. If the disqualification length is permanent, enter 999 in the Length field. If the court order does not specify length, the standard disqualification periods apply as shown in 1145.015.00 Disqualification Penalties.
- The begin date of the disqualification period is the date ordered by the court. If the court does not specify a begin date, the begin date is the month following the month of the court order. If action is not taken to begin the disqualification in 45 days or less, the disqualification period is considered to have begun the month following the month of the court order.
