SUBJECT:
TRACKING FAIR HEARINGS FOR FOOD STAMP CLAIMS
DISCUSSION:
Effective March 10, 2004 an indicator on the OVCC screen is added to record and track a fair hearing request on establishment of a claim by the EU.  Entry in these fields stops automated recoupment of food stamp benefits until a decision is entered.  Enter a “Y” followed by the date (MM DD YYYY) the hearing was requested in the FAIR HEARING REQ fields on the OVCC-CHANGE CLAIM INFORMATION screen.  These fields are mandatory when a hearing is requested on a food stamp claim establishment.   Do not make an entry in these fields if a hearing is requested on recoupment.
  • If the hearing is withdrawn, enter “W” followed by the date the hearing was withdrawn in the DECISION fields on OVCC-CHANGE CLAIM INFORMATION screen.  Record the reason for the hearing withdrawal on OVNA-NOTES ADD screen.  The recoupment begins 31 days after the date of the decision.
  • If the hearing is held, when the decision is rendered, enter the following on the OVCC-CHANGE CLAIM INFORMATION screen.
  •  If the agency is upheld a “U” is entered in the DECISION field, followed by the date of the decision.  The recoupment begins 31 days after the date of the decision.
  • If the agency is reversed an “R” is entered in the DECISION field, followed by the date of decision.  The claim is terminated.
NECESSARY ACTION:
  • Review this memorandum with appropriate staff.
  • Track food stamp claims hearings on the OVCC screen.
