SUBJECT:
TEMPORARY WAIVER NOTICES FROM DIVISION OF WORKFORCE DEVELOPMENT (DWD)
DISCUSSION:
When conditions for a temporary waiver (same as Family Support Division temporary exclusions) exist for longer than 12 consecutive months, DWD policy instructs DWD staff to review the case record with a supervisor and refer the individual back to the Family Support Division (FSD) for case management services. The referral back to FSD is currently accomplished using one of three alerts:
- Temporarily disabled/pregnant in 3rd trimester,
- Victim of domestic violence, or
- Active in Children's Division.
Upon receipt of one of the above alerts, FSD staff should take immediate action to begin case management:
- contact the individual to set up an assessment appointment;
- determine the current situation, establish if the person meets an exemption or temporary exclusion;
- complete a PACT listing the activities the individual and the worker agree to complete to overcome the barrier;
- update the work requirement code to reflect FSD is case managing the individual; and
- open the correct work component in the system.
Suggestions on activities to conduct with the individual are:
Temporarily Disabled Lasting Longer Than 12 Months
- Complete a current medical review and submit to the Medical Review Team (MRT),
- Instruct the individual to apply for Supplemental Security Income (if appropriate),
- Make a referral to Vocational Rehabilitation (if appropriate),
- Make referrals to agencies to assist individuals with disabilities (if appropriate), and
- If the individual is participating in a treatment or support group to overcome the barrier, enter the component activity in the system.
Victim of Domestic Violence Lasting Longer Than 12 Months
- Offer referrals to agencies that can assist the individual with legal matters, housing assistance, counseling, AL-ANON, etc., and
- If the individual is participating in a treatment or support group to overcome the barrier, enter the component activity in the system.
Active in Children's Division
- Contact the Children's Division worker to discuss the appropriate activities for the individual, and
- If the individual is participating in a treatment or support group to overcome the barrier, enter the component activity in the system.
NOTE: Supportive services should be provided to individuals who are being case managed by FSD staff.
Continue to case manage the individual until the individual no longer meets an exemption or a temporary exclusion. Refer the individual back to DWD when the individual is employment and training ready.
NECESSARY ACTION:
- Review this memorandum with appropriate staff.
- Case manage individuals referred back from DWD due to a temporary waiver/exclusion condition lasting longer than 12 consecutive months.
- Once individual is employment and training ready, refer the individual back to DWD for case management.
