The purpose of this memorandum is to inform staff that Food Stamp (FS) recertifications will be mailed to participants June 15-16, 2020 for cases due to recertify in July 2020

Due to the FS recertification waiver, which expires in June, cases that were due to recertify in March, April, May, and June 2020 were extended by 6 months.  Resuming FS recertifications may generate an increase in phone calls and questions from participants.

DISCUSSION:

The purpose of this memorandum is to discuss hazard pay for the Food Stamp (FS), Temporary Assistance (TA), Child Care (CC), and MO HealthNet (MHN) programs.

Hazard pay is additional pay for performing hazardous duty or work involving physical hardship.  If the participant receives hazard pay that is expected to be ongoing, even temporarily such as during an emergency period, it is included as part of their regular gross wages and not excluded as income or budgeted separately.  Hazard pay may also be shown as incentive pay on pay stubs.

Example:  Ms. Teel’s pay stubs for 4/30/2020 and 5/15/2020 verify gross wages in the amount of $550.  Her pay stubs also show she is paid $100 for hazard pay.  Ms. Teel’s gross wages for each pay period would be budgeted as $650.

Staff must enter detailed comments/notes in the eligibility system regarding the portion of wages that are hazard pay.  If the participant or employer indicates that hazard pay will only be received for a specific timeframe, comments/notes must include any information regarding the anticipated end date. 

NOTE:  In MEDES comments must be included on the evidence and person pages.

DISCUSSION:

Retirement accounts are an available resource to an MHABD or BP participant if the funds can be accessed by the individual.   This includes funds held in an IRA, 401, 403, Keogh, pension, or deferred compensation plan, even if there is a penalty.

The amount held in the account, less any penalty required for early withdrawal, is an available resource. Taxes withheld are not excluded from the value.

EXAMPLE: Mr. Banks has an IRA with a balance of $100,000.00. He reports he can’t access the funds in the account until he retires. Upon review, it is discovered Mr. Banks can access the funds with a 10% penalty for any withdrawals prior to retirement. There will also be a 15% withholding to pay taxes due for the withdrawal. The IRA ($100,000.00) less the early withdrawal penalty ($10,000.00) is an available resource to Mr. Banks ($90,000.00). The $15,000.00 withheld to pay taxes is not excluded.

IRA, 401(k), 403(b), Keogh, pension, or deferred compensation plan accounts belonging to the parent of a disabled child are not considered a resource for the disabled child, even if they are available to the parent. See 1025.015.07.05 Retirement Accounts Belonging to the Parent of a Disabled Child for more details.

The portion of retirement accounts funded by earnings received while an individual was receiving Medical Assistance for Working Disabled (MA-WD) is not an available resource until the individual turns age 65. Any remaining balance is a resource, if the individual has access to the funds. See 1025.015.09 Retirement Accounts Belonging to a Former MA-WD Participant for more details.

NEW MMMNA AND SHELTER STANDARD

Allotments for community spouses, minor children, and eligible dependents and the Minimum Monthly Maintenance Needs Allowance (MMMNA) and Shelter Standard are revised for actions effective the month of July 2020 and later.  The revised guidelines effective July 2020 are:

CASES ADJUSTED DURING MASS ADJUSTMENT

FAMIS uses the current standards for the allotment and surplus determinations completed prior to the mass adjustment.

If there is a community spouse, minor or eligible dependent, FAMIS determines the new allotment amount using the revised standards.  The new allotment for a community spouse, minor or eligible dependent displays on the Allotment Information (ALLOT, FMJ6) screen in FAMIS. The new allotment for a minor not living with the community spouse displays on the Minor Living Outside Allotment Information (MINOR, FMJ2) screen.

If there is a change in the surplus amount, the institutionalized spouse’s coverage is adjusted during the mass adjustment and a notice is sent to the participant. 

The coverage for the community spouse, minor or eligible dependent is NOT automatically updated.  Manual update of the allotment amount on the Select Income (SELINC) screen is required.  This will often result in an adverse action for the community spouse, minor or eligible dependent due to the increase in the allotment amount.

NOTE: Adverse actions are currently being suspended due to the COVID-19 emergency. 

The change in the surplus amount displays on the Adult MO HealthNet Vendor Budget Summary (FMD8) screen.

To access the Adult MO HealthNet Vendor Budget Screen:

  • Go to the EU Action Log (EULOG/FM40) screen;
  • Select a Budget Month;
  • Enter F17=INQAUTH;
  • Select F16=MHABD;
  • Select Coverage Type VEND and press F16=AGBUDSUM

After the adjustment, FAMIS determines allotments and surpluses for July 2020 and later using the new standards.

 

NOTICES

Cases resulting in no change from the mass adjustment do not receive an action notice.  The following notices are sent depending upon the action:

  • Adult MO HealthNet Benefit Action Notice (FA460) is sent for cases that result in an increase in benefits from the mass adjustment.
  • Adult MO HealthNet Adverse Action Notice (FA420) is sent for cases that result in a decrease in benefits due to the adjustment.
  • Adult MO HealthNet Benefit Notice (FA460) is sent once the adverse action notice expires.
  • Adult MO HealthNet Provider Notice (FA-465) is sent to the facility for cases that result in any change in benefits.

NOTE: Adverse actions are currently being suspended due to the COVID-19 emergency.

FAIR HEARING REQUEST

If the EU requests a fair hearing, send the request to the Administrative Hearings Unit (AHU) the same day. The IM Hearings Unit will send all Agency evidence to the AHU as soon as possible.  All available evidence should be sent to the AHU with the original request for hearing. Do not wait until a few days before the hearing to send the evidence.

For budget adjustments, evidence includes, but is not limited to:

  • FA-420 Adverse Action Notice
  • FA-460 Action Notice
  • Comments Screens
  • Manual sections/legal references
  • Adult MO HealthNet AG Budget Summary (FMD8) screen

Provide a copy of the evidence to the EU asking for the hearing and schedule a pre-hearing conference. If the EU designates an attorney or authorized representative for the hearing, send a copy of all notices and evidence for the hearing to the EU and the designated individual.
