DISCUSSION:

The purpose of this memorandum is to address changes to MAGI Allowable Deductions.  The 2018 Tax Reform introduced new schedules for the Internal Revenue Service (IRS) form 1040 (U.S. Individual Income Tax Return).  The IRS form 1040A and IRS form 1040EZ are no longer in use.  The change to the IRS form 1040 are additional schedules (1-6), which detail the allowable deductions for MAGI, as well as, alimony, business income or loss, real estate, royalties, partnerships, S corporations, trusts, farm income, and other income.

  • Only enter deductions allowable under MAGI guidelines
  • Not all schedules are applicable to MAGI
  • Tuition and Fees are no longer an allowable deduction
  • Moving Expenses are only allowable for certain Military Personnel

The purpose of this memorandum is to advise that the MAGI MO HealthNet Policy Manual sections 1805.030.20.05 Income Included Under MAGI and 1805.030.20.10 Income Excluded Under MAGI have been updated.

Updates include:

  • Changes in whether to include or exclude alimony from divorces and separation:
    • Finalized before January 1st, 2019: included
    • Finalized after January 1st, 2019: excluded
  • An increase in the tax filer threshold for earned income from a child to: $12,000 based on the 2018 IRS Publication 501
  • Updating the term “commuter expenses” to “per diem reimbursements for travel expenses”
  • Updated instructions on verifying excluded income to accept client statement unless there is inconsistent information

DISCUSSION:

IM Manual sections 0840.015.10 Reopening Closed Cases, and 0820.020.05.10  Cancelling a Rejection have been added to the MHABD policy manual.

MHABD cases may be reopened when the participant provides missing information that caused the closing.  Cancel closings may only be completed within 30 days of the date the closing action is complete if ALL missing information is submitted to FSD.

MHABD applications rejected for failure to provide requested information or failure to cooperate, may be cancel rejected if the participant provides All requested information by the application due date.

DISCUSSION:

The income and budgeting section of the MOCDD manual has been updated to discuss the budgeting of income that has been placed in a Qualified Income Trust (QIT). 

The QIT trust allows a participant to place some of his/her income into the trust to reduce his/her monthly income to fall below the HCB maximum.  QIT requirements are discussed in more detail in manual section 1025.015.04.01.02.

QIT trusts are an option for participants of the Home and Community Based Services (HCB), Program for All-Inclusive Care for the Elderly (PACE), and the Missouri Children with Developmental Disabilities (MOCDD) programs. 

All trusts, including QIT trusts, must be sent to the Program and Policy Unit for review using the Program and Policy SharePoint site.  The response from the Program and Policy Unit will include specific information regarding how to budget the diversion of monthly income that will be added to the trust, as well as guidance on how to budget disbursements from the trust.

As a result of the implementation of HB1565 (2016), asset limits for MO HealthNet for the Aged, Blind, and Disabled (MHABD) program have increased effective July 1, 2019.

            Individual asset limit is $4000.00.

            Couple asset limit is $8000.00.

Sections 0805.000.00 Eligibility and 0805.005.00 December 1973 Eligibility Requirements were updated to reflect current FSD programs.

Section 0805.010.00 MA/GR Dual Eligibility is now obsolete as the General Relief program is not currently funded.
