DISCUSSION:

The Families First Coronavirus Response Act (FFCRA) allows for Emergency Allotments (EA) of supplemental benefits for the Supplemental Nutrition Assistance Program (SNAP) to be issued to eligible SNAP households. The P-SNAP program raises a household’s SNAP allotment to the maximum amount for the household size.

Supplemental benefits have been issued by the Family Support Division (FSD) in March through October 2020 as part of the P-SNAP program. P-SNAP has been extended through November 2020. Beyond November 2020, participation in P-SNAP will be decided on a month to month basis during the COVID-19 health crisis.

SNAP households do not need to apply for P-SNAP. The supplemental benefit will be automatically added to the Electronic Benefit Transfer (EBT) card.

Note: Households that already receive the maximum allotment for their household size will not have a benefit increase.

The purpose of this memorandum is to advise staff of changes to the Former Foster Care Youth sections 1805.050.00 in the Family MO HealthNet (MAGI) manual and 0875.000.00 in the MO HealthNet for Aged, Blind, and Disabled (MHABD) manual.

Both policies have been updated to reflect that persons who have been in Foster Care in another state for at least six (6) months may be eligible for MO HealthNet coverage through the Children’s Division (ME 38).

DISCUSSION:

This memorandum announces the removal of the Program of All Inclusive Care for the Elderly (PACE) from programs designated as Qualified Income Trust (QIT) programs.

A participant may only use a QIT to reduce their income for:

  • Home and Community Based Services (HCB) program for persons age 63 and over, and
  • MO HealthNet for Children with Developmental Disabilities (MOCDD) for children under age 18.

The QIT template announced in 2019 memorandum IM-174 QUALIFIED INCOME TRUST (QIT) TEMPLATE (MO 886-4657) has been revised to remove PACE.

Income Maintenance manual section 1025.015.04.01.02 Qualified Income Trusts was previously updated to remove PACE.  This was announced in 2020 Memorandum IM-14  MANUAL REVISION FOR QUALIFIED INCOME TRUSTS FOR MO HEALTHNET FOR THE AGED, BLIND, AND DISABLED (MHABD).

Income Maintenance Memo #87 announced a change to how retirement accounts are counted for MHABD resource determinations.

A user guide was mentioned in that memo. An error was discovered on the user guide. This has been corrected and the corrected version has been posted and is attached to this memo.

The user guide incorrectly stated that an account available only for hardship reasons was considered accessible. This has been updated to reflect current policy. An account that is available only due to a hardship, is NOT an available resource.

DISCUSSION:

It is sometimes necessary to approve Nursing Home (vendor) Care on a date other than the date the participant was admitted to the facility. For example, this may be necessary if the individual has resources in excess of the program limit when they enter the facility, and then spends the resources down below the program resource limit.

EXAMPLE: Mr. Jacobs entered a nursing facility on August 5, 2019. He applied for vendor care on August 10, 2019. His resources were above the program limit. He stays at the facility as a private pay resident for his care until his resources are reduced below the program limit. Based on the cost of care and verified payment to the facility, his resources will fall below the resource limit effective September 15, 2019.
If eligibility is allowed to begin September 1, the facility would refund his private pay funds, causing his resources to again exceed the resource limit.

To avoid this cycle, eligibility for vendor coverage, in this example should not begin prior to September 15, 2019. This will be accomplished by entering the date his resources first fall below the program limit in the Payment Start Dt (Lev 2 Scrn) field on the Facility and Placement Information Details (FMJ5) screen in FAMIS.

Enter a comment to explain the reason for the date and how the date was determined.

The Facility and Placement Information Details (FMJ5) screen has been updated to allow entry of future dates. FAMIS will now accept future dates as far in the future as the first day of the last month that will be included in the current eligibility determination.

EXAMPLE: Eligibility determination (EDRES) completed October 1st will include October, November, and December. December 1, or earlier may be entered as the Payment Start Dt.

When an EDRES is completed, FAMIS will propose MHNS or MHSD for the days in the month prior to the date the resources were actually reduced below the limit, followed by vendor for the date the resources are first below the limit through the end of the month.

It is appropriate to allow the MHNS or MHSD to approve for the days of the month prior to the reduction of resources because the participant is eligible for the entire month in which their resources are below the limit.

DISCUSSION:

The purpose of this memorandum is to inform staff of updates to Veterans’ Benefits and Agent Orange Settlement Fund income in manual sections for the Temporary Assistance, MO HealthNet, Food Stamps, and Child Care programs. 

The funding for this settlement fund was created as a result of a class action lawsuit, Re: Agent Orange product liability litigation, M.D.L. No. 381 (E.D.N.Y).

The Agent Orange Settlement Fund closed in 1997. This unearned income source is no longer valid.

Updates have been made to explain benefits paid by the Veterans Administration (VA) to veterans with service-related disabilities include payments for disabilities due to exposure to Agent Orange.

Required Action:

Due to these updates, the Unearned Income (UI) sources of Agent Orange AETNA (AO) and Agent Orange Veteran’s Benefits (AV) are no longer valid. Until changes are made in FAMIS, discontinue using income types AV and AO in FAMIS.  Use income type VA for all disability payments issued by the Veterans Administration to disabled veterans. In MEDES, discontinue using income types Agent Orange Aetna and Agent Orange Veterans Benefits.
