DISCUSSION:

This memorandum introduces updates to the General Information manual section 0130.020.10 Appointment of an Authorized Representative to clarify a participant may designate an authorized representative without using the Appointing an Authorized Representative (IM-6AR) form or the Appendix C of the IM-1SSL MAGI application.

The Family Support Division (FSD) must accept the designation of an authorized representative on forms other than the IM-6AR or the Appendix C of the IM-1SSL MAGI application if all the necessary information is included on the document provided.

Missouri regulation 13 CSR 40-2.015 requires the alternative designation form to include:

  • The name of the person or organization designated to serve as the authorized representative;
  • The address of the authorized representative and the mailing address of the authorized representative (if different);
  • A phone number for the authorized representative; and
  • An attestation substantially in the following format: “In appointing my authorized representative, I understand that I will be legally bound and responsible for the actions of my appointed representative with respect to my application for or participation in the MO HealthNet program.” The attestation shall also contain or be accompanied by a signed authorization compliant with the Health Insurance Portability and Accountability Act (HIPAA) for the Department of Social Services to release protected health information to the authorized representative.

If staff has any questions about whether an appointment conforms to this language, they must submit to the MO HealthNet Program & Policy Unit for review.

FSD will not release participant information to an authorized representative until FSD has received a HIPAA compliant authorization and designation of authorized representative. This does not apply to a request for release of participant information from the participant’s attorney, spouse, attorney-in-fact, guardian, conservator, or court appointed public administrator.

DISCUSSION:

This memorandum is to update the Missouri Work Assistance (MWA) Policy for Service Providers section 0290.000.00 Sanction. This is a policy change due to Senate Bill 24; MWA contractors were trained in July 2015.

Policy has been revised.

  • The sanctioned TANF benefit amount has increased from 25% to 50%.
  • The policy now includes full-family sanctions.
  • The policy has been revised for clarification on processing sanctions.

The MWA Conciliation/Sanction Checklist has been removed.

Policy has been revised to reflect:

  • Procedure for conciliation has been revised for clarification of processes.
  • Timeframe for initiation of conciliation has been revised.
  • Some conciliation procedures have been automated.
  • MWA Conciliation/Sanction Checklist has been removed.

This policy revision clarifies the MWA Contractor role when FSD determines a participant is mandatory, but the participant reports they may meet a temporary exclusion. This policy was implemented on December 1, 2016 and MWA contractors were trained in November 2016.

DISCUSSION:

Clarification has been added to the MAGI MO HealthNet (MHN) policy manual for sanctions on individuals who fail to cooperate with Child Support (CS) in obtaining medical support.

When an individual is sanctioned, their MHN coverage ends. CS will notify the Family Support Division (FSD) when an individual has failed to cooperate by emailing FSD.MEDES@dss.mo.gov.

NOTE: FSD will determine if good cause exists; refer to section 1805.040.10.15.05 Determining Good Cause of the MAGI policy manual.

FSD must act on the sanction request within 10 days of receipt of the request.

DISCUSSION:

The purpose of this memorandum is to notify FSD staff of the change in 0280.10.00 Work Related Expense (WRE) for the Missouri Work Assistance Program (MWA). These changes took effect in 2016; an email memo was released but policy was not updated at that time. Policy has now been updated. This change increased the amount of WRE expenses allowable to MWA. WRE payments assist Temporary Assistance (TA) recipients by purchasing job-related items so the recipient can participate in employment and training activities.

  • The maximum amount of WRE that can be approved by a MWA Case Manager increased from $350 to $750 in a 12-month rolling period.
  • If the participant needs over $750 up to $1,500 this must be approved by a MWA Supervisor.
  • All previous requirements outlined in policy still apply.

DISCUSSION:

The purpose of this memorandum is to notify FSD staff of the change in 0280.005.00 Transportation Reimbursement Expense (TRE) for the Missouri Work Assistance (MWA) Program. These changes took effect in 2016; an email memo was released, but policy was not updated at that time. Policy has now been updated. This change increased the amount of TRE allowable to MWA participants as costs have increased since the last policy update and the lack of transportation funding restricts the participant’s ability to obtain and retain employment.

  • Transportation Reimbursement Expense (TRE) payments are issued to Temporary Assistance (TA) recipients to help with travel costs as they travel to employment and training activities.
  • TRE payments increased from a maximum of $5 per day to a maximum of $15 per day.
  • All previous requirements outlined in policy still apply.
