DISCUSSION:

The Food and Nutrition Services (FNS) option to waive SNAP recertification interviews has ended. SNAP recertification interviews resumed August 1, 2021.

NOTE:  Continue to waive recertification interviews for households in which all adult (18 and over) members are disabled or elderly, no household member has earned income, and there are no changes in circumstances. Use the SNAP Recertification Interview Decision Chart when determining if an interview is necessary.

Recertification applications that are pending when interviews resume (received prior to August 1, 2021) will be waived.

DISCUSSION:

Revisions have been made to the Estate Recovery section in 0880.005.00 of the MHABD Manual, and the December 1973 Eligibility Requirements Manual section 1025.015.04.01 on Special Needs Trusts, Supplemental Needs Trusts, and Pooled Trusts.

These sections have been updated to remove the descriptive stipulations surrounding when the MO HealthNet Division (MHD) Cost Recovery Unit will or will not file an estate recovery claim against the estate of an MHABD recipient or former recipient. This information is not necessary or required in order for Family Support Division (FSD) staff to determine eligibility for MHABD programs. Estate Recovery section 0880.005.00, has also been revised to include the current email address for the MHD Cost Recovery Unit, as listed below.

As a reminder, staff are prohibited from providing any financial planning advice to participants, authorized representatives, attorneys, or legal guardians. Estate recovery is a legal matter that is managed and overseen exclusively by the MHD Cost Recovery Unit. DISCUSSION:

During COVID-19 staff were allowed to provide flexibilities while working with participants to obtain verifications introduced in memo, IM-22 COVID-19 Verification for Food Stamps (FS), Temporary Assistance (TA) and Child Care (CC), dated 3/27/2020.

Beginning August 1, 2021, participants will be required to meet verification eligibility requirements as flexibilities will no longer be adequate when determining eligibility.

Discontinue using Collateral Contact (CC) to prevent cases from pending for verification that was not easily obtained. Instead, process requests for verifications and pending verifications according to pre-COVID-19 requirements.

If a common law marriage was established in another state, each partner is considered a spouse in Missouri. Common law marriages cannot be initiated in Missouri.

EXAMPLE: Edward and Ana state they are common law spouses. Their marriage began in Kansas, where common law marriages can be established. Consider them spouses for eligibility purposes.

Child Care will continue to follow Temporary Assistance policy for specified relatives. Refer to 2010.010.00 Relationship of the Applicant to the Child for more information.

IM-76 TAX CREDIT CHANGES RESULTING FROM THE AMERICAN RESCUE PLAN ACT (ARPA) OF 2021

DISCUSSION:

The ARPA modified the provisions of several commonly used tax credits. Most of the changes are in effect only for 2021. The following tax credits are refundable, meaning the credit amount can be paid directly to the tax filer if his/her tax liability is $0.

 

Child Tax Credit (CTC) Earned Income Credit (EIC) Child and Dependent Care Credit
A credit increase to $3600 for qualifying children ages 0-5; $3000 for children ages 6 through 17. The minimum age to qualify for the EIC is lowered to 19 and the maximum age is removed. The maximum amount of this credit increased to $6000 for one child and $16,000 for two or more children.
One-half of the estimated CTC amount is payable to parents in advance monthly payments starting in July 2021; the other half will be issued as part of 2021 tax refunds. The maximum income for an earner without children is increased to $9820.  
Tax filers will be able to opt out of the advance monthly payments. Some married filers may be treated as unmarried filers in certain circumstances.  

 

Do not count advance monthly payments or lump sum refunds of a refundable tax credit as income or a resource for Income Maintenance programs. For programs that consider resources, count tax credit funds remaining after 12 months as a resource.

DISCUSSION:

Additional exceptions have been added to the Social Security Number (SSN) requirements for MO HealthNet. Per 42 CFR 435.910(h)(1), an exemption to provide an SSN may be granted to a participant who:

  • is not eligible to receive a SSN or
  • does not have an SSN and may only be issued an SSN for a valid non-work reason in accordance with 20 CFR 422.10

In the eligibility system, record details regarding the exemption that was granted.

Section 1805.015.00 Social Security Number in the MAGI manual and section 1005.010.00 Social Security Number (OAA, AB, PTD) in the MHABD December 1973 Requirements manual have been updated to reflect the additional exceptions.

DISCUSSION:

Memo #63 released 6/28/2021 introduced the new form IM-1ABDS and stated that the IM-1MA is obsolete as of 7/6/2021. However, some clarifications are needed.

When a participant applies for MO HealthNet for the Aged, Blind, and Disabled using the Application for Health Coverage & Help Paying Costs (IM-1SSL), and does not submit the IM-1ABDS, staff should attempt to contact the applicant by phone. If unable to collect the information by phone, staff must mail the
IM-1ABDS to the participant with a request for contact.

As of 7/6/2021, the IM-1MA is obsolete and should not be distributed by FSD staff. The MO HealthNet for the Aged, Blind, and Disabled appendices (IM-1MA appendices) are still valid and remain in the Department of Social Services Forms Manual. IM-1MA applications will remain available to staff and the public until 7/6/2021.

FSD will honor IM-1MA’s received between 7/6/2021 and 12/31/2021 as applications. An IM-1MA received prior to 12/31/2021 MUST be processed as a valid application.

NOTE: If an IM-1MA is received after 12/31/2021, FSD staff must send an IM-1SSL and IM-1ABDS to the participant. If the IM-1SSL is returned within 30 days, the date of application is the date the IM-1MA was first received.

DISCUSSION:

Manual revisions have been made to the MO HealthNet for the Aged, Blind, and Disabled (MHABD), Family MO HealthNet (MAGI), Supplemental Nutrition Assistance Program (SNAP), and Temporary Assistance (TA) policy manuals regarding returned mail. There has been no change to Child Care (CC) policy regarding returned mail.

United States Postal Service (USPS) stickers are placed on mail that is undeliverable. This information shows a forwarding Missouri address, a forwarding out of state address, or no forwarding address (unable to locate). Returned mail may be handled differently depending on the program and the information provided on the sticker.

To ensure consistency across all IM programs, the manual sections shown above have been created or revised. The following information summarizes changes made for each program.

Note: No adverse actions will be taken on any MO HealthNet cases during the COVID-19 Public Health Emergency.

MHABD: A new manual section has been added to the MHABD policy manual which addresses returned mail received by the Family Support Division (FSD).

MAGI: The manual section below has been updated regarding returned mail received by FSD.

SNAP: Due to Simplified Reporting, no action can be taken when returned mail is received by FSD. The manual sections below have been updated.

TA: The returned mail procedures outlined in this memorandum will change processes for TA cases. The TA manual outlines specific procedures for returned mail in relation to the Missouri Work Assistance (MWA) program and TA Drug Testing policy. The manual sections below related to returned mail and unable to locate have been updated to reflect changes in procedure when returned mail is received by FSD.

DISCUSSION:

Effective July 1, 2021, the Minimum Monthly Maintenance Allowance (MMMNA) and Shelter Standard for Vendor cases are increased. The eligibility system adjusts all Vendor cases on June 12, 2021.

NEW MMMNA AND SHELTER STANDARD

Allotments for community spouses, minor children, and eligible dependents and the MMMNA and Shelter Standard are revised for actions effective the month of July 2021 and later. The revised guidelines effective July 2021 are:

Minimum Maintenance Standard $ 2,178
Shelter Standard $ 653

CASES ADJUSTED DURING MASS ADJUSTMENT

The eligibility system uses the current standards for the allotment and surplus determinations completed prior to the mass adjustment.

If there is a community spouse, minor or eligible dependent, the eligibility system determines the new allotment amount using the revised standards. The new allotment for a community spouse, minor or eligible dependent displays on the Allotment Information (ALLOT, FMJ6) screen. The new allotment for a minor not living with the community spouse displays on the Minor Living Outside Allotment Information (MINOR, FMJ2) screen.

If there is a change in the surplus amount, the institutionalized spouse’s coverage is adjusted during the mass adjustment and a notice is sent to the participant.

The coverage for the community spouse, minor or eligible dependent is NOT automatically updated. Manual update of the allotment amount on the Select Income (SELINC) screen is required. This will often result in an adverse action for the community spouse, minor or eligible dependent due to the increase in the allotment amount.

NOTE: Adverse actions are currently being suspended due to the COVID-19 public health emergency (PHE).

The change in the surplus amount displays on the Adult MO HealthNet Vendor Budget Summary (FMD8) screen.

To access the Adult MO HealthNet Vendor Budget Screen:

  • Go to the EU Action Log (EULOG/FM40) screen;
  • Select a Budget Month;
  • Enter F17=INQAUTH;
  • Select F16=MHABD;
  • Select Coverage Type VEND and press F16=AGBUDSUM

After the adjustment, the eligibility system determines allotments and surpluses for July 2021 and later using the new standards.

NOTICES

Cases resulting in no change from the mass adjustment do not receive an action notice.
